GENERAL TERMS AND CONDITIONS FOR DISTANCE SELLING

ARTICLE 1 – DEFINITIONS

1.1 “GTC” refers to these General Terms and Conditions, which govern all remote sales between Cannabuben and the CUSTOMER. These apply exclusively to the online sale of products available on the website www.cannabuben.eu, which is freely accessible to all internet users.

1.2 “CUSTOMER” refers to any natural or legal person of legal age who purchases from the SERVICE PROVIDER. The person or entity accepting these GTC (by signing or confirming an order) guarantees payment, even if acting on behalf of a third party.

1.3 The website operated by MJ Helvetica s.r.o. will hereafter be referred to as the “WEBSITE”: https://cannabuben.eu/, where these GTC are published.

1.4 “PRODUCT” refers to any item managed and marketed by MJ Helvetica s.r.o. in Europe.

ARTICLE 2 – CONFLICT WITH THE GTC

2.1 The GTC govern exclusively the online sales contracts of MJ Helvetica s.r.o. products with customers and, along with the online order, constitute the legally binding documents between the parties, excluding any other documents, brochures, catalogs, or product images, which are for reference only.

2.2 The GTC apply only to products delivered to customers residing in Metropolitan France, overseas territories, and/or an EU Member State.

2.3 The GTC and all contractual information on the WEBSITE are provided in French.

2.4 The GTC are available to consumers on the seller’s WEBSITE, where they can be accessed directly.

2.5 The GTC become binding on the CUSTOMER once they confirm their awareness and acceptance by ticking the designated checkbox before finalizing their order. Confirming the order serves as acknowledgment of the valid GTC at the time of purchase.

2.6 MJ Helvetica s.r.o. reserves the right to modify the GTC at any time. If changes occur, the GTC applicable at the time of the order will prevail. A copy with the current date can be provided to the CUSTOMER upon request.

2.7 If any contractual clause is deemed void, it does not invalidate the entire GTC, except in cases where the clause in question was fundamental and decisive for the contract.

ARTICLE 3 – PRODUCTS

3.1 The products offered for sale are presented in the online catalog on the WEBSITE and include descriptions detailing their essential characteristics as per Article L. 111-1 of the Consumer Code. If usage information is essential, it will be included in the product description or provided upon delivery.

3.2 Product images are for illustrative purposes only and are not legally binding.

3.3 Products are offered and supplied based on available stock.

3.4 The CUSTOMER can view detailed descriptions of each product by clicking on the item on the WEBSITE.

3.5 All products listed on the WEBSITE are subject to availability. MJ Helvetica s.r.o. reserves the right to modify its product catalog at any time.

3.6 Orders placed before any catalog updates will be honored under the previous conditions.

3.7 The products comply with European regulations at the time of sale.

ARTICLE 4 – PRICING

4.1 Product prices are displayed in Euros (€), including all taxes (VAT included), but excluding delivery and shipping costs.

4.2 The product price valid at the time of order placement is the applicable price.

4.3 Shipping and transport costs are provided before order confirmation and are charged separately, unless free shipping conditions apply.

4.4 MJ Helvetica s.r.o. reserves the right to modify prices at any time but guarantees that the customer will pay the price displayed at the time of order confirmation.

4.5 For deliveries to French overseas territories (DOM-TOM), VAT is not applicable, but customs duties may be required.

ARTICLE 5 – OFFERS

5.1 Online sales offers presented on the WEBSITE are exclusively available to customers residing in the EU and designated territories.

5.2 Offers are valid as long as they appear in the catalog and are subject to stock availability.

5.3 The customer’s acceptance of an offer is validated through a double-click confirmation process, ensuring order approval.

ARTICLE 6 – CUSTOMER ACCOUNT

Before placing an order, the CUSTOMER may create an account by filling in the required information in the “My Account” section. They must provide accurate details and may not impersonate third parties or falsify their age.

The CUSTOMER is responsible for maintaining the confidentiality of their username and password.

ARTICLE 7 – ORDER PLACEMENT

7.1 Online purchases are restricted to individuals over 18 years old with legal capacity to enter purchase agreements.

7.2 Wholesale buyers, resellers, or individuals intending to resell products are strictly prohibited from placing orders on the WEBSITE.

7.3 The contract is finalized when the CUSTOMER confirms the order. A confirmation email will be sent upon successful payment.

7.4 MJ Helvetica s.r.o. reserves the right to reject orders for legitimate reasons, particularly in cases where:

Order quantities appear abnormally high for an individual customer.
A legal dispute is ongoing with the customer.
The customer has previously violated the GTC.
Fraudulent activities (e.g., credit card fraud) are suspected.

ARTICLE 8 – PAYMENT

8.1 Product prices are displayed in Euros (€) and include VAT as per the Consumer Code.

8.2 Payment can be made via credit card or through WeldPay and Vivawallet services.

8.3 Payments are processed through secure connections, ensuring full confidentiality.

8.4 In case of non-payment within 10 days, the contract will be automatically canceled.

ARTICLE 9 – DELIVERY

9.1 Products are shipped only after payment is received to the address provided by the CUSTOMER.

9.2 Estimated delivery times:

Orders are processed within 24-48 hours, depending on the chosen shipping method.
Delays due to force majeure or unforeseen circumstances are not the responsibility of MJ Helvetica s.r.o..

9.3 Shipping costs are displayed separately before checkout.

ARTICLE 16 – PRICE ERRORS & REFUNDS

Unintentional pricing errors may occasionally occur. In such cases, we reserve the right to cancel or adjust your order. If your order is affected, we will inform you promptly.

If a price error occurs and you have already made a payment, you will have the option to receive a full refund or accept the adjusted price.
